ROLL-OFF DUMPSTER TERMS & CONDITIONS

All containers are delivered C.O.D. unless previously agreed to in writing.

By accepting delivery of the container/s the customer agrees to all of the terms herein.

The customer is responsible and liable for any damage to the containers while in his care.

Container service time is for 1 week (7 days).

There will be an extra $10.00 per day rental fee for any days over the 1 week period (7 days).

There will be a $75.00 charge for any unsuccessful attempts to deliver, exchange or final the container/s to the customers job site through no fault of 1•866•JUNK•BE•GONE.

There is a 2 ton weight limit per container and there will be an extra $75.00 per ton charge for any overweight containers. Customer will not overload container/s by volume past the containers height. There is an extra $100.00 charge for overloaded container/s.

There will be a $39.00 per month / per invoice late fee for unpaid bills past 30 days.

In case of a dispute 1•866•JUNK•BE•GONE shall be entitled to recover for all collection efforts.

Attorney’s fees are $500.00 or 40% of the awarded amount, whichever is greater.

1•866•JUNK•BE•GONE is not liable for the delay or failure to perform due to contingencies beyond its control, acts of God, strikes, fires, compliance with laws or governmental orders, or inability to get to container and such failure shall not constitute a default under this agreement.

1•866•JUNK•BE•GONE may, without notice, dump the contents of the container/s, on site, and remove the container/s due to the customers refusal to pay C.O.D., unauthorized material in the container/s or previous unpaid bills.

The Customer will pay for all permit fees and/or franchise fees and further warrants that he has the necessary permission and permits to do the stipulated work. The Customer further agrees to hold harmless and defend 1•866•JUNK•BE•GONE, at his expense, in any conflict arising from the performance of this work.

1•866•JUNK•BE•GONE is not responsible for any damage done to the driving surfaces (driveways, sidewalk, lawns, fences and shrubbery etc.) in its attempt to deliver, exchange or retrieve the container/s at Customers job site.

Customer further warrants that he is authorized to order the work and that he alone is responsible for payment as stipulated and that this order is not subject to approval and/or collection from a third party.

EXCLUDED MATERIALS: Concrete, sand, rocks, tiles, tree trunks, paint, chemicals, any kind of oil or lubricant or solvents, any kind of contaminated materials, materials containing asbestos, gas containers (full or empty), any combustible or volatile material, any highly flammable or explosive materials, any biomedical or infectious material, any toxic or hazardous waste, any excrement materials, dead animals, nuclear material, automobile tires or batteries, roofing materials or any appliances containing Freon gas or any other materials characterized as hazardous by the United States Environmental Protection Agency. 1•866•JUNK•BE•GONE shall acquire title to the acceptable waste materials when it is loaded into the dumpster however title to and liability for any excluded material shall remain with the Customer and he expressly agrees to defend, indemnify and hold harmless 1•866•JUNK•BE•GONE from and against any and all damages, fines, penalties and liabilities resulting from and/or arising out of Customers loading excluded materials into dumpsters. Dumpster/s are not water tight and Customer shall not load any material which could leak.

Customer warrants that any right of way provided by the Customer to 1•866•JUNK•BE•GONE for the purpose of maneuvering, delivering, exchanging or removing the dumpster is sufficient to bear the weight of all of the contractors trucks, dumpster and equipment. Any damage to the surface or subsurface or anything under the surface shall be the responsibility of the Customer. Customer hereby grants access into his property to 1•866•JUNK•BE•GONE for the purposes of performing the specified work.

Responsibility for the dumpster remains with the Customer, while on his property, and Customer agrees not move or alter the dumpster/s in any way and shall use same for its proper and intended purpose. 1•866•JUNK•BE•GONE is the only entity authorized to move the truck, dumpsters or equipment.
